General Terms of Use for Player Account

Preamble
Equinox is the publishing company of the game "Altered" accessible from its website www.altered.gg. It provides Users with a "Player Account" reserved for them.
This document is specific to this space and cannot restrict or substitute other documents such as information notices, general terms of sale, privacy policy, and cookie policy.
Purpose
These General Terms aim to define the conditions of use for the Player Account and Services accessible from the altered.gg website.
These general terms are specifically intended to define:
- the conditions under which a User can create and use their portfolio of intangible assets attached to each card for which they hold digital ownership;
- the use of Services offered to Users with a Player Account.
These terms do not define the conditions of sale for cards between players and/or professionals, which are governed by complementary General Terms called "Wallet General Terms."
These terms also do not define the conditions of sale for the Print on demand service, which are governed by complementary General Terms called "Print on demand General Terms."
Duration
These General Terms come into force from their acceptance by the User at the time of account creation and until its final closure.
Enforceability
These General Terms are enforceable from their acceptance by the User, materialized by checking a box when creating the Player Account.
Equinox reserves the right to make any changes to these general terms that it deems necessary and useful.
Each new version will be communicated to Users for acceptance. Without acceptance, the User's Player Account will be automatically closed by Equinox.
The version enforceable against the User is, in any case, the one accessible from the altered.gg website.
Creation of the Player Account
Opening a Player Account is free.
To create a Player Account, the User must follow the account creation process:
Step 1: the visitor completes a first form indicating their email address and password.
Step 2: they receive an email message containing an account activation link. By clicking on "Activate my account," the User accesses a page on the altered.gg website where they are asked to validate their email address.
Step 3: the User is then redirected to a form where they provide their first name, last name, nationality, chosen site language, date of birth, and the local currency used in which prices will be displayed. They then choose a username and confirm their acceptance of the General Terms of Use of the altered.gg website.
The User guarantees the accuracy of the information provided for registration purposes for their Player Account.
Users under fifteen (15) years of age at the time of registration must provide authorization from the persons holding parental authority.
Access
The User's identifiers, namely their email address and password, are strictly personal and confidential, and any use of these identifiers is presumed to be made by the User. The User is responsible for actions carried out from their Player Account.
The User is solely responsible for preserving and maintaining the confidentiality of their identifiers and agrees to take all useful measures to ensure this perfect confidentiality. In case of forgetting or compromising their password, the User can change it by following the provided procedure.
Usage
The User uses the Services accessible on the altered.gg website for non-professional purposes only. Carrying out professional activities requires the creation of a Shop Account and acceptance of the "Shop General Terms".
In any case, the User agrees to respect the rules of the Altered game set by Equinox.
Any use of content, Services, or any other element related to the altered.gg website not provided for is illegal and will be sanctioned by Equinox.
Creating the Collection
The User can find on the altered.gg website all the cards for which they have digital ownership (their "collection").
To create their collection, the User can:
- Receive digital ownership of cards through gifts or exchanges with other Users registered as their "Friends";
- Buy or sell digital cards from the Market (see the "Wallet General Terms");
- Scan the QR Code of their physical cards from the Altered mobile application.
The first person to scan the QR Code on a physical card automatically acquires its digital ownership.
The Altered mobile application can be downloaded from the Google Play or iOS app stores.
Before being able to exchange or give cards to another User, they must be on the "Friends" list. Gifts sent or exchanges validated by both Users are irrevocable.
A card put up for sale on the Market Place automatically blocks the possibility of giving or exchanging it.
Events
The User can register for Altered game tournaments organized by Equinox or by third parties.
A non-exhaustive list of tournaments is available online.
To register, the User chooses the event they wish to participate in, consults the available information about it, and can pre-register. The event organizer is then free to validate or not the User's participation. The User can also unregister.
In any case, by registering for an event, the User agrees to respect the rules of the Altered game, the tournament rules, and these General Terms.
Equinox's Responsibility
Equinox commits to implementing all reasonable means to ensure the accessibility and proper functioning of the altered.gg website.
Equinox cannot be held responsible for interruptions, malfunctions, or unavailability of the site, particularly related to telecommunication or electricity network failures affecting Internet access or cyberattacks impacting the availability of the altered.gg website by Equinox.
Equinox draws the User's attention to the fact that the first User to scan the QR code of a physical card becomes the owner of the digital version of that same card, as long as it has not been exchanged, given, or sold.
Equinox cannot be held responsible for the loss of digital ownership of a card in the event where the first holder of the physical card did not immediately scan it after opening a Booster.
User's Responsibility
The User is fully responsible for the use made of their Player Account, even in case of loss or theft of their identifiers.
The User is responsible for the data and content they use on the altered.gg website, within the limits of Equinox's data protection policy https://www.altered.gg/fr-fr/privacy-policy/.
Account Closure by the Player
The User can delete their Player Account at any time by following the procedure outlined in the Player Account settings.
The closure of the Player Account, for any reason whatsoever, implies the loss of all information and access to Services. Personal data linked to the Player Account is anonymized. All other data is irreversibly deleted, including the digital ownership of cards held by the User.
However, the User can request the release of digital ownership of cards in their collection at the time of deleting their Player Account.
WARNING: In this case, a card whose digital ownership has been released can be scanned and integrated into another User's collection.
The deletion of the Player Account is irreversible; recovery of identifiers or associated data is not possible.
Suspension or Closure of the Account by Equinox
Equinox reserves the right to suspend for a more or less extended period or to delete at any time the Player Account of a User who would fail to respect these General Terms or who would have behavior deemed abusive.
Any proven abuse will be sanctioned in a graduated manner, depending on the severity of the behavior and its consequences on the proper functioning of the altered.gg website and related elements, such as events.
For example, Equinox considers abusive any behavior aimed at disrupting participation in events, such as registering with the aim of disrupting the smooth running of events or preventing other players from participating, or registering for events without participating.
The User is informed by email of the nature and duration of the sanction, the reasons that led to its implementation, and the possibility of contesting this sanction if applicable.
Equinox is also entitled to remove any content that would violate these General Terms and, more broadly, the applicable laws in this area.
OWNERSHIP of the altered.gg Website
Equinox is and remains the holder of all rights relating to the altered.gg website as well as its content. This includes, without this list being exhaustive:
- The structure and architecture of the site;
- Texts, graphics, images, logos;
- Databases and their arrangement;
- Any other element making up the site, except for content provided by Users.
Evidence Agreement
Connection data, logs, and other technical data are considered to have probative value.
This provision should be considered as an evidence agreement.
Personal Data and Cookies
For more information on the processing of personal data, the User can refer to Equinox's personal data protection policy by clicking here.
During a visit to the site, cookies or connection witnesses may be installed in the User's terminal.
Information regarding the use of cookies on the site, their management, and their deletion by the User is detailed in the "cookies policy" accessible by clicking here.
Nullity
If one or more provisions of these terms are held to be invalid or declared as such pursuant to a law, regulation, or following a decision with the force of res judicata from a competent jurisdiction, the other provisions will retain all their force and scope.
Language of the General Terms
In case of translation, the version of these General Terms that prevails is the French version.
Applicable Law and Competent Jurisdiction
The rights and obligations of the Parties under this contract are governed by French law, with the sole reservation that this does not deprive the Client of the protection conferred, if applicable, by the mandatory provisions of the country where they have their habitual residence.
For Users residing in France, French jurisdictions are competent to hear any dispute related to these terms.
For Users residing outside of France and in a country where Equinox makes its Services available, the User benefits from the mandatory provisions of the law of the country where they have their residence.
Shop Account Terms of Use

Preamble
Equinox is the publishing company of the game "Altered" accessible from its website www.altered.gg. It provides professionals acting for commercial purposes with a "Shop Account" reserved for them.
This document is specific to this space and cannot restrict or substitute other documents such as information notices, general terms of sale, privacy policy, and cookie policy.
Purpose
These general terms aim to define the conditions for creating and using the Shop Account and Services accessible from the altered.gg website.
AT THIS STAGE, EQUINOX EXCLUDES THE POSSIBILITY FOR SHOPS TO BUY OR SELL DIGITAL OWNERSHIP OF CARDS FOR PROFESSIONAL PURPOSES.
SHOPS LIMIT THEIR USES TO PROMOTIONAL ACTIONS FOR THEIR STORE AND THEIR EVENTS.
Duration
These general terms come into force from their acceptance by the Shop Representative (the "Representative") at the time of creating the Shop Account and until its final closure.
Enforceability
These general terms are enforceable from their acceptance by the Representative, materialized by checking a box when creating the Shop Account.
The version of these terms enforceable against the Representative is the one accessible on the site.
Updating These Terms
Equinox reserves the right to make any changes to these terms that it deems necessary and useful.
Any modification will be communicated to the Shop. Use of the Shop Account constitutes acceptance of the new general terms.
Access
The Shop Account identifiers are strictly personal and confidential, and any use of these identifiers is presumed to be made by the Shop and/or its Representative on behalf of the Shop.
The Shop is solely responsible for preserving and maintaining the confidentiality of its identifiers and agrees to take all useful measures to ensure this perfect confidentiality. In case of forgetting or compromising the password, the Representative can change it by following the provided procedure.
Usage
The Shop can create its card collection and game decks under the same conditions as a User acting for non-professional purposes. These conditions are detailed here.
The Shop can create events from its Shop Account to offer Altered game tournaments in its store(s).
The Shop is solely responsible for the content (texts, images, photos, logos, or others) that it makes public when filling out event creation forms. Equinox cannot be held responsible for events occurring during tournaments organized by Shops.
The Shop is responsible for actions carried out from its Shop Account. By creating its Shop Account, it declares that it meets Equinox's technical and editorial prerequisites.
Any use of content, Services, or any other element related to the altered.gg website not provided for is illegal and will be sanctioned by Equinox.
The Shop agrees to use its Shop Account under the conditions defined herein and in particular:
- not to commit acts of infringement, not to reproduce, represent, or modify all or part of the altered.gg website;
- not to disrupt the proper functioning of the altered.gg website.
Equinox's Responsibilities
Equinox commits to implementing all reasonable means to ensure the accessibility and proper functioning of the altered.gg website.
Equinox cannot be held responsible for interruptions, malfunctions, or unavailability of the site, particularly related to telecommunication or electricity network failures affecting Internet access or cyberattacks impacting the availability of the altered.gg website by Equinox.
Equinox acts exclusively as a host for information and data posted online by Shops on its altered.gg website and cannot be held responsible for communication, by a Shop, of illegal content or content contrary to the general terms defined by Equinox.
Equinox is also entitled to remove any content that would violate these terms and, more broadly, the applicable laws in this area.
Shop's Responsibility
The Shop is fully responsible for the use made of its Shop Account, even in case of loss or theft of its identifiers, namely its email address and password.
The Shop is fully responsible for content communicated by it on the altered.gg website.
The Shop is fully responsible for the conduct of tournaments it organizes.
Deletion of the Shop Account
The Shop can delete its Shop Account at any time by following the procedure outlined in the Shop Account settings.
The digital ownership of cards owned by the Shop remains associated with the Shop Account. However, the Shop can request the release of digital ownership of cards in its collection at the time of deleting its Shop Account. In this case, a card whose digital ownership has been released can be scanned and integrated into another User's or Shop's collection.
Equinox reserves the right to delete at any time the Shop Account of a Shop that would fail to respect these general terms or that would have behavior deemed abusive.

General Terms of Use for the Wallet (online wallet)

Preamble
Equinox is the publishing company of the game "Altered" accessible from its website www.altered.gg. It provides the User with a Service for buying and selling digital ownership of Altered cards found in their Collection.
The User must have created a Player Account, accepted these general terms, and have a Wallet ("electronic wallet") to have the possibility of buying or selling the digital ownership of Altered game cards.
Purpose
These General Terms aim to define the conditions under which a User can buy and sell digital ownership of Altered cards on the altered.gg website, for non-professional purposes only.
Duration
These General Terms come into force from their acceptance by the User, at the time of activation of their Wallet, and until the closure of the Wallet.
Enforceability
These General Terms are enforceable from their acceptance by the User, materialized by checking a box when activating the Wallet.
Equinox reserves the right to make any changes to these General Terms that it deems necessary and useful.
Each new version will be communicated to Users for acceptance. Without acceptance, the User's Wallet will be automatically closed by Equinox.
The version enforceable against the User is, in any case, the one accessible from the altered.gg website.
BUYING and SELLING digital ownership of Altered cards
Users can sell and buy digital ownership of Altered game cards. The act of purchase and the act of sale are materialized by clicks; there is no written contract.
Users agree to follow the technical processes made available by Equinox and to respect the prerequisites and functional requirements demanded by Equinox.
Equinox's only role is to set up a technical tool that allows the sale and purchase of digital ownership of cards between Users, as consumers, therefore for non-professional purposes. Users who sell and buy digital ownership of cards are in direct relationship, which does not legally implicate Equinox.
Cards offered for sale can only be digital cards of the Altered game, created by Equinox and registered by the User in their collection.
The User can put up for sale the digital ownership of cards found in their collection. They indicate the desired selling price, the quantity available within the limit of the number of copies they own, and validate the listing. If they have several digital ownerships of the same card, they can put them all up for sale at the same price.
When the User validates the listing of digital ownership of a card, this constitutes a promise of sale. Consequently, they accept that it may be purchased at any time at the requested price.
The indicated selling price is the final price; it includes all applicable taxes. The User can, at any time, withdraw the cards they have put up for sale.
Each completed sale is irrevocable.
The User can purchase digital ownership of Altered game cards. They can only purchase one digital ownership at a time or several ownerships of the same card from the same seller.
The User materializes their consent to purchase a card by clicking on the order validation button.
The purchase results in the transfer of the sum of money corresponding to the selling price between the buyer's Wallet and the seller's Wallet. No invoice is issued for the act of purchase.
As soon as the acquisition is completed, the User benefits from the digital ownership of the card. They can use it immediately on the altered.gg website.
The user cannot exercise a right of withdrawal for the purchase of digital cards.
Use of the wallet
The use of paid Services available on altered.gg – card purchases and Print on demand – requires prior activation of the Wallet by the User. Indeed, payments made on the altered.gg site are made exclusively with the Wallet, which must be funded according to the User's needs.
Wallet activation is free.
When activating the Wallet, the User chooses their two-factor authentication method and provides their billing and delivery address.
If the delivery country is different from the billing country, Equinox may ask the User for supporting documents and suspend access to paid Services pending receipt of the supporting documents.
If the supporting documents provided by the User do not allow Equinox to identify the taxes to be applied, the latter may ask the User that their delivery address be identical to their billing address. In case of refusal by the User, their access to paid services will be suspended.
To validate an address or a change of address and validate the activation of the Wallet, the User will have to use two-factor authentication.
Access to paid Services is subject to the provision of the information requested when creating the Wallet, their validation by the two-factor authentication service, and the acceptance of these General Terms and those of the payment service provider.
Recharging the Wallet is done in the currency chosen at the time of creating the Player Account, in euros or US dollars, exclusively through credit card payment.
During each Wallet recharge, the payment service provider and the banks of the payment issuer proceed with an analysis of the transaction, in order to limit the risks of fraudulent behavior. As part of this analysis, certain recharges could be blocked. In this regard, Equinox cannot be held responsible for any refusal of recharge blocked for suspicion of fraud.
The User expressly acknowledges that the communication of their banking details during the recharge constitutes authorization to debit their account up to the amount indicated by them.
If applicable, a notification of cancellation of the recharge for payment default is sent to the User by Equinox to the email address provided when creating the Player Account.
The conversion fees of the banking institution used to fund the Wallet are the responsibility of the User.
Amounts paid into the Wallet to recharge it are not refundable.
Only earnings from sales made on the Market Place can be transferred from the Wallet to a bank account of the User. The User must provide their banking information and billing address to transfer their earnings.
The closure of the Player Account automatically leads to the closure of their Wallet. The earnings contained in the Wallet are automatically paid back to the User, to the bank account whose details were provided when creating the Wallet. The fees of the payment service provider will be deducted from the transfer.
Applicable fees
No fees are applied to recharging the Wallet.
5% fee, taxes included, is applied on each sale of digital cards. These fees are borne by the seller and deducted from the seller's earnings. The minimum fee charged, taxes included, is 3 cents.
Our payment service provider's fees are applied during transfers of earnings to the User's bank account.
The fees applied by the payment service provider and by Equinox are indicated before the User validates the action giving rise to a money transfer. The fees indicated are those applicable at the time of the money transfer.
Discount vouchers may be allocated to users (example: printing defect of a card in a pack) for Print on demand. These vouchers are all taxes included.
The tax conditions that apply during transactions carried out on the Wallet are detailed here.

General Terms and Conditions (GTC) for the Print on Demand Service

Preamble
Equinox is the publishing company of the board game "Altered," accessible from its website www.altered.gg. It provides the User with a Service for printing Altered game cards.
Scope of the general terms and conditions of sale
These general terms and conditions of sale ("GTC") apply to the Print on Demand Service offered by Equinox, a simplified joint-stock company, registered in the Paris Trade and Companies Register under number 894 382 746, with its registered office at 36 rue Vaugelas, 75015 Paris, through the website accessible at altered.gg (the "Site").

Purpose
These general terms and conditions are intended to govern the conditions of use of the Print on Demand Service to the exclusion of any other contractual commitment by Equinox.
The conditions under which the service is implemented are defined on the Site as well as the legal or technical constraints (age, quantity, delivery locations, etc.).
The User confirms having read the information available online and considers it sufficiently clear to order the Print on Demand Service.
Acceptance of the GTC
The updated version of the GTC is accessible online.
When placing an order, the User confirms having read the GTC, which can be kept by downloading or printing, and accepts them without reservation. This acceptance is irrevocable.
This acceptance is renewed with each order. Only the GTC accepted at the time of the order are binding on the parties, excluding previous versions of the GTC.
Equinox keeps a record of this acceptance.
Prerequisites
In order to place an order, the User must have accepted the general terms of use of the Altered Player Account and have created a Player Account.
Since the Print on Demand Service order is exclusively paid with the Wallet, the User must have a Wallet, the conditions of which are specified here.
All of these general conditions form a coherent whole. If, however, a contradiction between these texts were to be found, these GTC will prevail over the others.
Order
The User is solely and entirely responsible for orders placed with their credentials (email address and password).
Before validating their cart, the User has the possibility to correct the information in their order. The User is responsible for verifying and validating their order. After validation and payment of the order, it is irrevocable.
Equinox cannot be held responsible for errors made by the Customer in the information provided at the time of ordering.
The User receives a confirmation email of their order with all the information.
Equinox reserves the right not to fulfill the order placed by the User, particularly in the case of:
- orders exceeding, by their content or frequency, the needs of an individual and, more generally, in the case of abnormal requests or bad faith from the User;
- orders from a User with whom Equinox has a payment dispute on a previous order or who would have acted in disregard of these GTC;
- suspicion of fraud;
- legitimate reason as provided for in Article L. 121-11 of the Consumer Code.
Price and payment
Pack prices are the same in euros (EUR) or US dollars (USD).
Discount vouchers may be allocated to users (example: printing defect of a card in a pack).
The prices of foil or non-foil packs are identical. They are indicated on the Print on Demand page - https://www.altered.gg/printing. For European Union member countries, prices include VAT. For other countries, the indicated price does not include VAT, not applicable in accordance with the provisions of Section I of Article 262 of the French General Tax Code, and it also does not include any applicable local taxes, indicated before order validation.
The price does not include potential customs duties applicable in the destination country. These remain the responsibility of the User.
Before validation of the order by the User, the price indicated during the order includes all taxes as well as delivery.
The User validates their order by clicking on the corresponding button. By validating the order, the User accepts the price set at the time of the order and agrees to pay for the order.
Payment for the order is made exclusively through the Client's Wallet upon validation by the Client.
Delivery
Equinox ensures delivery of the order to the address indicated by the User during the order. The User is responsible for the accuracy of the information provided during the order.
Deliveries are made by the service provider chosen by Equinox.
Delivery is considered to have been made when the User or a third party designated by them is in physical possession of the order.
Delivery times are indicated to the User before the confirmation of the order.
In the event of exceeding the delivery date indicated by Equinox, and outside cases of force majeure, the User may cancel their order if, after having given Equinox formal notice to make the delivery within an additional period of ten (10) days, the latter has not complied with this deadline.
The User then informs Equinox of this cancellation by registered letter with acknowledgment of receipt to the contact details mentioned in the "Customer Service" article of these GTC.
The order is considered cancelled upon receipt by Equinox of the written notification of this cancellation, unless Equinox has complied in the meantime.
When the order has been cancelled by the User, Equinox will refund the User's order(s) within a maximum period of fourteen (14) days following the date on which the contract was terminated.
The User may address a complaint to Equinox in case of damage noted on their order related to delivery. They refer to the Customer Service whose contact details are indicated below.
Customer Service may ask the User to provide supporting evidence for the complaint.
When their complaint is accepted by Equinox's Customer Service, the User ships their order back to Equinox. The order must not have been used and must be returned intact in its original packaging.
No Right of Withdrawal
In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made according to consumer specifications. Therefore, the User does not have a right of withdrawal insofar as the Packs produced within the framework of the Print on Demand service are manufactured according to their specifications.
Warranties
The consumer has a period of two years from the delivery of the goods to implement the legal warranty of conformity in the event of a conformity defect appearing. During this period, the consumer is only required to establish the existence of the conformity defect and not the date of its appearance.
When the contract for the sale of the goods provides for the supply of digital content or a digital service continuously for a period exceeding two years, the legal warranty is applicable to this digital content or digital service throughout the supply period provided for. During this period, the consumer is only required to establish the existence of the conformity defect affecting the digital content or digital service and not the date of its appearance.
The legal warranty of conformity obliges the professional, if necessary, to provide all updates necessary to maintain the conformity of the goods.
The legal warranty of conformity gives the consumer the right to repair or replace the goods within thirty days following their request, without charge and without major inconvenience to them.
If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests the repair of the goods, but the seller imposes replacement, the legal warranty of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods or terminate the contract with full refund against return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods occurs after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience for the consumer, particularly when the consumer permanently bears the costs of collecting or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods;
4° The non-conformity of the goods persists despite the seller's attempt to bring them into conformity which has remained unsuccessful.
The consumer also has the right to a reduction in the price of the goods or to terminate the contract when the conformity defect is so serious that it justifies an immediate reduction in price or termination of the contract. The consumer is then not required to request the repair or replacement of the goods beforehand.
The consumer has no right to terminate the sale if the conformity defect is minor.
Any period of immobilization of the goods for repair or replacement suspends the warranty that remained to run until the delivery of the goods returned to working order.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
The seller who in bad faith obstructs the implementation of the legal warranty of conformity incurs a civil fine of a maximum amount of 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal warranty against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This warranty gives the right to a price reduction if the goods are kept or to a full refund against return of the goods.
In the case of seeking amicable solutions prior to any legal action, these do not interrupt the time limits for legal warranty actions.
The legal warranty of conformity and the legal warranty against hidden defects are not mutually exclusive.
FORCE MAJEURE
In the event of the occurrence of a force majeure event within the meaning of Article 1218 of the Civil Code preventing the execution of the order or these General Conditions, Equinox informs the User within fifteen (15) days from the occurrence of this event, by email or by registered letter with acknowledgment of receipt.
All obligations of the parties are suspended during the entire duration of the force majeure event, without compensation. If the force majeure event continues for more than three (3) months, the transaction concerned may be terminated at the request of Equinox or the User without compensation from either party.
PROTECTION OF PERSONAL DATA
The conditions related to the processing of personal data by Equinox are specified in the General Policy for the Protection of Personal Data https://www.altered.gg/fr-fr/privacy-policy/.

Partial Invalidity
If one or more provisions of these General Terms and Conditions of Sale are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall remain in full force and effect.
Duration
These general conditions come into force from their acceptance by the User, upon finalization of their order and until the expiration of all contractual or legal warranty periods.
Evidence Agreement
Connection data, logs, and other technical data are considered to have probative value.
This provision must be considered as an evidence agreement.
Nullity
If one or more provisions of these terms are held to be invalid or declared as such pursuant to a law, regulation or following a decision having the force of res judicata by a competent court, the other provisions shall remain in full force and effect.
Language of the general conditions
In case of translation, the version of these General Terms and Conditions of Sale that prevails is the French version.
Dispute Resolution
Mediation
In case of dispute, the User must address Equinox in writing, in order to find an amicable solution, at the contact details indicated in the "Customer service" article.
The User is informed that they may, in any event, resort to consumer mediation, in accordance with the provisions of Articles L. 611-1 et seq. of the Consumer Code.

In accordance with the rules applicable to mediation, any consumer dispute must be the subject of a prior written complaint to Equinox's Customer Service, whose contact details are indicated in the "Customer Service" article, before any request for mediation.
Users residing in a Member State of the European Union, as well as in Norway or Iceland, may use the services of the European Consumer Centre: Network of European Consumer Centres.
Competent Jurisdictions
For Users residing in France, French courts have jurisdiction to hear any dispute related to these terms.
For Users residing in the EU, in a country where Equinox makes its Services available, the User may bring an action before the competent courts of the State in which they reside or before the competent courts of the jurisdiction of the Paris Court of Appeal.
Applicable Law
French law applies to orders placed by Users having their habitual residence in a Member State of the European Union, with the sole reservation that this does not deprive the User of the protection conferred, if applicable, by the mandatory provisions of the country where they have their habitual residence.
